Zero deductible under MCA 33-23-304  ·  ✓ 12+ carriers direct-billed  ·  ✓ OEM glass covered  ·  ✓ ADAS calibration included

SHORT ANSWER

Yes — if you carry comprehensive auto insurance in Montana, your windshield replacement is $0 out of pocket.

Montana is one of a handful of states with a statutory zero-deductible glass law (MCA 33-23-304). If your comprehensive policy is in force, the carrier pays the full cost of glass replacement — including OEM glass and ADAS recalibration — and cannot apply your normal deductible. It does not raise your rates and does not count as an at-fault claim. Call (737) 843-0004 with your carrier name and we’ll verify your coverage in under 5 minutes.

MONTANA CODE ANNOTATED · TITLE 33 · CHAPTER 23 · PART 3

What MCA 33-23-304 Actually Says — And What It Means For You

Montana law prohibits property and casualty insurers from applying a deductible to the repair or replacement of motor vehicle safety glass when coverage is provided under a comprehensive policy. This has been the law in Montana since 1993 and remains in effect today.

“An insurer authorized to transact insurance in this state that writes a policy of motor vehicle insurance covering damage to the insured motor vehicle by other than collision, upset, or a specifically named peril… may not require the insured to pay a deductible for the repair or replacement of motor vehicle safety glass.” — MCA § 33-23-304

In plain English, this means:

  • If you have comprehensive coverage, glass is $0 out of pocket — no matter what your normal deductible is ($100, $500, $1,000 — none of it applies to glass)
  • The law covers full replacement, not just repair — if your windshield is beyond repair, the carrier pays for the full new windshield
  • The law covers ADAS recalibration when the vehicle requires it — that is treated as part of the replacement, not a separate service
  • The law applies to all Montana-registered vehicles carrying Montana-issued comprehensive coverage
  • The law does not increase your premium and does not count as an at-fault claim on your record
  • You have the right to choose your own shop — the carrier cannot force you to use their preferred network

⚠ KNOW YOUR RIGHTS

Your Adjuster May Try to Steer You. Here’s What to Say.

When you file a glass claim, some carriers route you to a third-party network (Safelite Solutions, LYNX Services, or similar) and quietly imply you must use their preferred shop. You are not required to. Montana law and your policy contract both give you the right to choose any AGSC-registered installer.

If the adjuster pressures you, say: “I’m exercising my right under my policy to use my chosen AGSC-registered shop, Windshield Missoula Pros. Please open the claim and provide the claim number.”

Why it matters: Preferred networks often use aftermarket glass (not OEM), skip full ADAS calibration, and offer 12-month warranties instead of lifetime. Choosing your own certified installer typically means better glass, thorough calibration, and warranty coverage for as long as you own the vehicle.

If you’ve already been steered elsewhere and something went wrong, call us. We can often intervene, re-open the claim, and correct the install — still at $0 out of pocket under Montana law.

Insurance FAQ — What Missoula Drivers Ask Most

Call (737) 843-0004 and we’ll confirm your specific policy in under 5 minutes.

Will filing a glass claim raise my insurance rates?

No. Glass claims filed under comprehensive coverage in Montana are considered no-fault and do not raise your premium. They do not count as an at-fault claim on your driving record. This is one reason MCA 33-23-304 exists — the state wants people to fix cracked windshields promptly rather than drive with them.

Does insurance cover ADAS calibration too, or just the glass?

Yes, ADAS calibration is covered as part of the replacement. Under Montana law and standard industry practice, calibration required to restore forward-camera, lane-keeping, and automatic-emergency-braking systems is treated as part of the glass service — not a separate diagnostic charge. Static calibration ($150–$300 retail) and dynamic calibration ($180–$350) are both covered at $0 out of pocket.

What if I only have liability coverage?

Liability-only policies do not cover glass. You’d pay out of pocket at the cash prices above ($240–$1,850 depending on vehicle). If you don’t currently carry comprehensive, adding it typically costs $8–$20/month in Montana — and one windshield replacement usually pays for 2–3 years of premium. Worth reviewing with your agent before your next chip becomes a full crack.

Does the zero-deductible law apply if I chip is repairable, not replaceable?

Yes — and repairs are actually cheaper for the carrier, which is why they encourage them. A chip repair runs $50–$120 retail, covered at $0 under comp coverage. Most carriers waive any co-pay because repairing a small chip prevents a $500–$1,500 replacement claim later. Call as soon as you notice a chip — Missoula winter freeze/thaw cycles turn small chips into full cracks fast.

What if I bought my car recently and the policy is under 30 days old?

You’re still covered from day one on a new comprehensive policy. There’s no waiting period for glass coverage in Montana. The only exception is if the damage occurred before the policy started — carriers will check the date, and we’ll help document that the damage happened during the coverage period.

Do I need OEM glass, or is aftermarket okay?

Under Montana law, your carrier must offer OEM if the vehicle requires it for warranty or ADAS functionality. For vehicles under 3 years old, still under manufacturer warranty, we recommend OEM — some manufacturers void ADAS warranties if non-OEM glass is used. For older vehicles, high-quality aftermarket (Pilkington, PPG, Fuyao) is usually fine and functionally identical. We’ll walk you through what’s right for your specific vehicle.

What if my carrier sends me a check and tells me to pay the shop myself?

You don’t have to accept that. Some carriers try to close claims fast by cutting a check for a low estimate and telling you to pay whatever’s left. We bill the carrier directly — you don’t handle checks or reimbursement. If a carrier insists, we can push back with the full itemized invoice and negotiate the correct amount. In Montana, they’re required to pay the reasonable cost of a compliant replacement, not a lowball estimate.

What if I’m out-of-state insured but driving a Montana-registered car?

Your out-of-state policy’s rules apply, not MCA 33-23-304. The Montana zero-deductible law only applies to policies issued and delivered in Montana. If you’re insured in another state and driving here, your normal deductible ($100–$500 typical) may apply. Call us with your carrier and state — we’ll check your specific policy language.

Can I use my Montana insurance at your shop if I’m visiting from out of state?

Yes — if you have Montana comprehensive coverage, MCA 33-23-304 applies wherever the damage happens. We handle installations for Missoula-based drivers who cracked windshields on trips to Yellowstone, Glacier, or elsewhere, then came home for the fix. Coverage follows the policy, not the location.
